Congresswoman Gwen Moore Applauds Wisconsin’s Final Removal From Multi-State ACA Lawsuit Washington, D.C. – Congresswoman Gwen Moore (WI-4) statement on Wisconsin’s removal from a multi-state lawsuit, Texas v. United States, at the Appellate Court level that seeks to dismantle the Affordable Care Act: “Wisconsin is moving in the right direction and I’m so proud to hear that of the United States Court of Appeals for the Fifth Circuit grant the state’s motion to be dismissed from the Republican lawsuit that seeks to destroy the Affordable Care Act. The last thing we need are more people without adequate health coverage and high prescription costs that disproportionately impact low-income families and individuals. This is a win for Wisconsin taxpayers and those who benefit from the ACA, including those with pre-existing conditions. Let me say it again; health care is a right, not a privilege as Republicans want to spin it out to be. I applaud this decision by this court,” said Congresswoman Gwen Moore. The Texas case has appeared in both the District Court and the Appellate Court. The District Court case is Texas v. United States of America, No. 4:18-cv-00167 (N.D. Tex. filed February 26, 2018). The appellate case is State of Texas v. USA, No. 19-10011 (5th Cir. docketed January 7, 2019).
